NOTICE OF ANNUAL MEETING

 

The Tenaya Estates, Inc., (TEI) Annual Meeting will be held on Saturday, April 5, 2014, at 9:00 a.m. at the basketball court at the Park.  The Treasurer will provide a report on Park finances and the President will provide an update on Park operations.  Ballots for the 2014 election of TEI Board members will be counted and the results announced.     

 

2014 Elections Process

 

The 2014 election will be conducted by mail ballot.  There are 143 homeowners in the Tenaya Estates homeowners association who are eligible to vote.  Voters must be property owners to vote.  Each property is entitled to one vote.  Voting will be by written ballot.  The one designated voting representative from each property will be required to sign the official “ballot return envelope.”  The ballot will contain the names of all candidates who were nominated by the January 31, 2014, deadline.  Since there are more than 4 candidates, the 4 candidates with the highest number of votes will win provided, however, that each candidate must receive 50% plus one vote to be elected. 

 

If a run-off election must be held for those who didn’t obtain 50% plus 1, the election will be held by subsequent mailed ballot.  Candidates who receive a majority vote will be elected to the Board immediately.  The subsequent election will be held by mail vote until all candidates are elected by 50% plus 1.  Tie votes will be decided by drawing straws.

 

To maintain the secrecy of each vote, the official “ballot return envelopes” will not be opened in advance.  At the annual meeting, the President will appoint a Teller to count the ballots.  The Teller will verify that official “ballot return envelopes” are signed, open the envelopes, remove the ballots, separate ballots and envelopes to insure secrecy, and count the ballots.  Candidates can observe the ballot counting process.  The results of the election will be announced immediately after all ballots are counted unless there is a challenge to a voter’s eligibility to serve or to vote.

 

Challenges to a voter’s eligibility to serve on the Board or to vote must be in writing.  The Board will investigate challenges only in cases when the challenge could change the outcome of the election.  The Immediate Past President will conduct the investigation and determine the validity of the challenge within 7 days.  The results of the election will be announced after all challenges have been resolved.

**  As provided for in the TEI Bylaws, Michael Jenkins nominated himself for the Board by the January 31 deadline.  The TEI Board remains concerned about his qualifications.  Mr. Jenkins and/or his wife, Janine Gallego, are advertising, and appear to be operating, a dog sitting business from their home in violation of the Tenaya Estates CC&Rs and without the required Fresno County permit for home based businesses.  The Board sent Mr. Jenkins a letter regarding this matter on February 18, 2014.  As of this mailing, Mr. Jenkins has not responded to the Board’s letter.
